ScrollFit - Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the ScrollFit mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

ScrollFit is a digital wellness application that promotes healthy screen time habits by requiring users to complete physical exercises to earn access to entertainment applications on their mobile devices.


2. Description of Service

2.1 Core Functionality

ScrollFit provides the following services:

  • Exercise Tracking: Real-time pose detection for push-ups, squats, and planks.
  • Screen Time Management: Time-based access control for selected entertainment apps.
  • App Blocking: Temporary restriction of access to distracting applications.
  • Digital Wellness: Tools to promote healthy technology usage habits.

2.2 Technical Requirements

  • Android 7.0 (API level 24) or higher.
  • Camera access for pose detection.
  • Accessibility service permissions for app monitoring.
  • Display overlay permissions for blocking screens.
  • Device administrator permissions for security.

3. User Accounts and Registration

3.1 Account Creation

  • Users may create accounts using email/password or Google Sign-In.
  • All registration information must be accurate and current.
  • Users are responsible for maintaining account security.
  • One account per user is permitted.

3.2 Free Trial

  • New users receive a 24-hour premium trial upon registration.
  • No payment information is required for trial access.
  • Trial automatically expires without charges.
  • Premium features become limited after trial expiration.

4. Privacy and Data Protection

4.1 Data Collection

We collect minimal data necessary for app functionality:

  • Authentication Data: Email, display name, profile information.
  • Usage Statistics: Exercise completion, time earned, app blocking events.
  • Device Information: Android version, device model for compatibility.

4.2 Data Storage

  • Local Storage: Exercise data and preferences stored on your device.
  • Cloud Storage: Only authentication data stored securely via cloud services (for example, Firebase).
  • No Video Recording: Camera used only for real-time pose detection.
  • No Personal Data Sales: We never sell your personal information.

4.3 Data Security

  • All data transmission is encrypted using industry-standard protocols.
  • Local data is protected using Android's secure storage mechanisms where applicable.
  • We aim to perform regular security reviews and updates.
  • We strive to align with privacy regulations such as GDPR and CCPA where applicable.

5. Permitted Uses

5.1 Acceptable Use

You may use ScrollFit for:

  • Personal fitness tracking and digital wellness.
  • Managing your own screen time and app usage.
  • Educational purposes related to healthy technology habits.

5.2 Prohibited Uses

You may not:

  • Attempt to bypass or disable security features.
  • Reverse engineer or modify the application.
  • Use the app for commercial purposes without permission.
  • Share account credentials with others.
  • Interfere with other users' experience.

6. Premium Subscription

6.1 Premium Features

Premium subscription includes:

  • Unlimited app blocking (free version may be limited to a smaller number of apps).
  • Advanced scheduling and analytics.
  • Priority customer support.
  • Early access to new features.

6.2 Billing Terms

  • Subscriptions are processed through Google Play Store.
  • Example pricing: Monthly: $4.99/month, Yearly: $39.99/year (or equivalent in your local currency).
  • Automatic renewal unless cancelled at least 24 hours before the renewal date.
  • Refunds are subject to Google Play Store policies.
  • Price changes will be communicated in advance where required.

6.3 Cancellation

  • You can cancel anytime through Google Play Store.
  • Access continues until the end of the current billing period.
  • No partial refunds for unused portions of a subscription period.
  • Cancelled accounts retain access to the free tier, if available.

7. Health and Safety

7.1 Medical Disclaimer

  • Consult Healthcare Providers: Seek medical advice before starting any exercise program.
  • Exercise at Your Own Risk: We are not liable for injuries resulting from physical activity.
  • Listen to Your Body: Stop exercising if you experience pain, dizziness, or discomfort.
  • Not Medical Advice: App guidance is educational and motivational, not medical advice.

7.2 Exercise Safety

  • Ensure adequate space for safe exercise performance.
  • Use proper form and technique to prevent injury.
  • Stay hydrated and exercise within your capabilities.
  • Consider your fitness level and any medical conditions.

7.3 Technology Safety

  • Take regular breaks from screen time.
  • Maintain good posture while using devices.
  • Be aware of your surroundings when using the app.
  • Report any technical issues that could affect safety.

8. Intellectual Property

8.1 Our Rights

  • The ScrollFit name, logo, and branding are our trademarks.
  • The app code, algorithms, and design are our intellectual property.
  • Exercise detection technology and related features are proprietary.
  • All content and materials provided through the App are protected by copyright and other laws.

8.2 Your Rights

  • You retain ownership of your personal data.
  • You are granted a limited license to use the app for its intended purposes.
  • You have the right to request export of your account-related data where technologically feasible.
  • You have the right to request deletion of your account and associated data, subject to legal obligations.

9. App Permissions and Security

9.1 Required Permissions

  • Camera: Real-time exercise pose detection (no recording).
  • Accessibility Service: Monitor selected app usage for screen-time control.
  • Display Overlay: Show blocking screens and timers.
  • Device Admin: Prevent unauthorized app removal.
  • Internet: Authentication, subscription validation, remote configuration, and analytics/crash reporting.

9.2 Security Features

  • Device administrator protection can help prevent unauthorized uninstallation.
  • Settings protection may prevent disabling of core security features without explicit confirmation.
  • Multiple monitoring services may be used to ensure consistent functionality.
  • Boot protection can automatically restart necessary services after device reboot.

9.3 Permission Usage

  • Permissions are used only for the purposes stated in these Terms and in the Privacy Policy.
  • No unauthorized data collection or transmission is performed.
  • Users can revoke permissions at any time, although this may affect functionality.
  • Clear explanations are provided for each permission request where possible.

10. Limitation of Liability

10.1 Service Availability

  • The App is provided "as is" without warranties of any kind.
  • We do not guarantee uninterrupted or error-free service.
  • Technical issues may occasionally affect functionality.
  • Maintenance and updates may cause temporary unavailability.

10.2 Liability Limits

  • To the maximum extent permitted by law, our total liability is limited to the amount you paid for premium features during the preceding 12 months.
  • We are not liable for indirect, incidental, or consequential damages.
  • We are not responsible for failures of third-party apps or services.
  • Users are responsible for their own digital wellness decisions and outcomes.

10.3 Force Majeure

We are not liable for delays or failures due to:

  • Natural disasters or acts of God.
  • Government actions or regulations.
  • Internet or telecommunications failures.
  • Other circumstances beyond our reasonable control.

11. Termination

11.1 Termination by User

  • You may delete your account at any time through in-app settings where available.
  • You may uninstall the app to discontinue service.
  • You may contact support to request complete data deletion where technically feasible.
  • Subscription cancellation must be done through Google Play Store.

11.2 Termination by Us

We may terminate or suspend accounts for reasons including, but not limited to:

  • Violation of these Terms of Service.
  • Fraudulent or illegal activity.
  • Abuse of the service or other users.
  • Non-payment of subscription fees where applicable.

11.3 Effect of Termination

  • Immediate loss of access to premium features.
  • Local data may remain on your device.
  • Cloud data associated with your account may be deleted within a reasonable period.
  • No refunds for unused portions of subscription periods, except where required by law or Google Play policies.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of your applicable jurisdiction (for example, the laws of India if you are operating from India), without regard to conflict of law principles.

12.2 Arbitration

  • Where permitted by law, disputes may be resolved through binding arbitration.
  • Arbitration will generally be conducted on an individual basis (no class actions), under applicable arbitration rules.
  • The location and rules of arbitration may be specified in a more detailed agreement or local legal requirements.

12.3 Exceptions

The following disputes are not subject to arbitration where applicable law allows:

  • Intellectual property infringement claims.
  • Small claims court matters.
  • Requests for injunctive or equitable relief.

13. Changes to Terms

13.1 Modification Rights

  • We may update these Terms periodically as the App evolves.
  • Material changes will be communicated via in-app notification or other reasonable means.
  • Continued use of the App after changes constitutes acceptance of the new Terms.
  • Previous versions may be available upon request.

13.2 Notification Process

  • We may provide advance notice for significant changes where required.
  • Notifications may be sent via email to registered users.
  • Notifications may also appear as in-app messages or notices.

14. Miscellaneous

14.1 Entire Agreement

These Terms constitute the entire agreement between you and ScrollFit regarding use of the App and supersede any prior agreements.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

14.3 No Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of our rights.

14.4 Assignment

You may not assign these Terms or any rights or obligations under them without our prior consent. We may assign our rights and obligations under these Terms as permitted by law.
